Constellation — Engagement Agreement
Physician-Led Cardiac Health Education Offered by Deft Heart LLC
About This Agreement
Constellation offers spacious, unhurried educational conversations with Timothy Thayer, MD, a board-certified cardiologist, focused on helping you understand your cardiac situation and navigate your healthcare decisions with greater clarity.
The goal is to help you better understand medical information, organize your questions and concerns, and prepare for conversations with the healthcare professionals responsible for your care.
This agreement explains what Constellation provides, what it does not provide, and what you can expect from the engagement.
1. What Constellation Provides
Constellation provides cardiac health education.
Constellation’s goal is to provide a thoughtful educational conversation that helps you understand important concepts, clarify your questions and priorities, and prepare for discussions with your healthcare team.
Dr. Thayer’s medical training and experience inform the education he provides. During a session, he may:
• explain cardiac conditions, medical terminology, tests, medications, procedures, and treatment concepts;
• describe considerations that clinicians and patients commonly discuss when evaluating treatment options;
• help you better understand information your treating healthcare professionals have given you;
• help you identify questions you may want to discuss with your healthcare team; and
• help you think through your priorities, values, quality-of-life concerns, and other practical considerations surrounding healthcare decisions.
Dr. Thayer provides these services as an educator. Through Constellation, he does not undertake responsibility for your diagnosis, treatment, medical management, monitoring, or follow-up care.
2. How Constellation Fits With Your Medical Care
Constellation is designed to complement the care you receive from your treating doctors and other healthcare professionals, not replace it.
Dr. Thayer can help you understand medical concepts and prepare for conversations with your healthcare team. Your treating healthcare professionals remain responsible for diagnosis, prognosis, interpreting tests and medical records, medication decisions, treatment recommendations, and determining what care is medically appropriate for you.
If a question calls for an individualized medical judgment, Dr. Thayer may help you reframe it into questions or considerations you can discuss with your treating team.
Because every situation is different, no particular medical, personal, or decision-making outcome is promised.
3. Medical Information and Records
During a session, you are welcome to describe information your treating healthcare professionals have given you and to read or briefly display part of a written report so that Dr. Thayer can help explain terminology or generally applicable medical concepts.
To keep the conversation within its educational scope, Constellation does not accept medical records for advance review, and Dr. Thayer does not independently interpret imaging, laboratory results, ECGs, reports, or other records to determine what they mean for your diagnosis, personal risk, or treatment.
Constellation ordinarily does not retain copies of records you display during a session.
4. Your Medical Care and Decisions
Your treating doctors and other healthcare professionals remain responsible for your medical care.
Medical decisions should be made with professionals who know your medical history, can examine you when appropriate, and are responsible for your diagnosis and treatment.
Any decisions about starting, stopping, delaying, or changing treatment should be made with the healthcare professionals responsible for your care.
You remain responsible for the decisions you make about your healthcare. Constellation can help you understand concepts, clarify your priorities, and prepare questions, but it does not make medical decisions for you.
5. Emergencies and Ongoing Care
Constellation does not monitor your condition between sessions or provide on-call or ongoing clinical care. Messages to Constellation should not be used for urgent medical concerns. For a medical emergency, please call 911 or seek emergency care. For urgent or other medical concerns, please contact the healthcare professional responsible for your care.
If something you share during a session raises an urgent concern, Dr. Thayer may pause the conversation and encourage you to contact an appropriate healthcare professional or emergency service.
6. Your Location
We will ask you to provide your current physical location when booking and to confirm it at the beginning of your session. Please let Constellation know if your location changes before or during the session.
Constellation may decline, cancel, or end a session if applicable law does not permit the service to be provided where you are physically located. If Constellation cancels a session for this reason before the session is provided, any amount paid for that session will be refunded.
7. Additional Participants
You may invite up to two adult family members, caregivers, or other trusted persons to participate in your session.
Each additional participant must agree separately to Constellation’s Guest Terms before joining the session. By inviting someone to participate, you authorize Constellation to discuss information you choose to share while that person is present.
Additional participants are welcome to support you and take part in the conversation about your situation. Questions about a participant’s own health should be addressed separately with that person’s healthcare professionals.
Constellation may decline or end the participation of anyone who has not agreed to the Guest Terms or who does not follow the requirements applicable to the session.
8. Keeping the Conversation Private
To support a candid and private conversation, please do not make or permit audio or video recordings, screen recordings, screenshots, automated transcripts, AI-generated notes, or other captures of the session without Constellation’s prior written permission.
If you need an accommodation that involves recording or transcription, please contact Constellation beforehand so an appropriate arrangement can be considered. Constellation may end a session without refund if the recording requirement is not honored.
9. Privacy and Confidentiality
Constellation will use reasonable measures to protect the privacy and confidentiality of information you share.
Information may be disclosed when you authorize it; when reasonably necessary for vendors or professional advisers who assist Constellation and are expected to protect the information; when required by law or legal process; or when disclosure is otherwise required or permitted by applicable law.
A Constellation session may not be protected by a physician-patient evidentiary privilege. Constellation’s confidentiality commitment does not create a legal privilege where one does not otherwise exist.
Additional information about how Constellation collects, uses, stores, and protects personal and health information is provided in Constellation’s Privacy Policy.
10. Fees, Cancellations, and Rescheduling
The fee for your session will be disclosed before you book and is due at the time of booking.
If you need to cancel or reschedule, please notify Constellation as early as possible. Sessions cancelled with less than 48 hours’ notice may be subject to a cancellation fee of up to the full session fee.
If Constellation must cancel a session, you may reschedule or receive a refund of the amount paid for that session.
11. General Terms
This agreement contains the understanding between you and Deft Heart LLC regarding your Constellation session and replaces any earlier discussion or communication about the terms of the engagement.
If any part of this agreement is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Tennessee law governs the interpretation of this agreement to the extent permitted by law. This provision does not override licensing, privacy, recording, consumer-protection, or other mandatory laws that apply because of your location.
You may enter into this agreement electronically. An electronic acceptance or signature has the same effect as a handwritten signature.
12. Acknowledgment
By accepting this agreement, you confirm that you have read and understood it and agree to the terms above.
In particular, you understand that Constellation provides cardiac health education and does not take responsibility for your diagnosis, treatment, or ongoing medical care, and that medical decisions remain between you and the healthcare professionals responsible for your care.
